Maintenance of public highways such as roads and pavements is governed by the Highways Act 1980.
The criteria for making such claims are relatively simple.
- Pictures. The provision of the Highways Act require councils and local authorities to carry out inspections on roads and pavements regularly, i.e. every 6 months, where it is deem dangerous for motorists and pedestrians. This mean that the defect must meet the criteria in that it is dipped/raised to ONE INCH on pavements and TWO INCHES on roads. Go back to the area where you fell and take a picture of the defect using something such as a ruler to give an idea of scale, and measure the width and depth of a pothole. Or get someone to do that for you.
