Construction worker in wheelchair following accident at work
A 29-year-old builder has suffered serious personal injury following an accident at work which resulted in him being crushed underneath a wall.
His employer had employed outside contractors for building work at the company’s facility at Broad Oak, Hilsea, when a heavy-duty wall that he was in the process of relocating trapped his legs, crushing his feet and ankles, which has left him unable to continue to work. The victim now requires the use of a wheelchair.
BAE Systems may now face the possibility of an unlimited fine for their negligence in the incident. BAE Systems pleaded guilty to breaches of the Construction, Design and Management Regulations, along with BS Interiors (South) Ltd and principal contractor Emcor Facilities Services Ltd.
In a magistrate’s court, the maximum fine for this breach would have been £5,000; however, the case has now been referred to the Crown Court, where there is no such limitation.
Additionally, the possibility has been raised that the victim could seek compensation for his accident, since it has seriously affected his quality of life, leaving him in a wheelchair and unable to work. Since his employer can be held accountable in this work accident case, he could stand to receive significant compensation.
