Metal worker makes public liability claim
A 45-year-old metal worker from Reading recently found success in his public liability claim against a local restaurant which failed to ensure that it was safe for all of its customers.
The man, who wishes to remain anonymous, had taken his family out for a meal. On making a trip to the toilet, which was up an unsafe flight of stairs, he tripped on a loose step, falling backwards down the staircase and incurring severe injury to his head, as well as suffering two broken ribs and a fractured shoulder.
It emerged later that the restaurant’s management were well aware of the loose step, which other customers had suffered near-miss encounters with, yet had failed to take any action in ensuring that the step was secured to protect their customers.
The man realised he could make a public liability claim against the restaurant’s management. The court, hearing about the management’s clear negligence in ignoring the problem presented by the loose step, ruled in the man’s favour, awarding him a significant sum in compensation. The man said that he was very happy with the compensation money, but that he is moreover pleased to have ensured that the step no longer poses a danger to other unsuspecting customers.
