Victory for Women Appealing For Public Liability Compensation

A woman who suffered grievous injury in a road traffic accident in the year 2004 has won public liability compensation against the council that was responsible for the untidy state of the bushes on the central reservation.

She was hit by a taxi while crossing the road which resulted in a fractured neck and some internal injuries. The pedestrian later appealed against a ruling which declared that she was not eligible for the claim against the council as she herself was to be blamed for the incident which occurred due to her carelessness.

Giving their verdict on the appeal, the judges stated that the council was the guilty party as the lady’s vision was obscured due to the unkempt and outgrown bushes. The judges’ added that it was the council’s duty to trim down the bushes to enable proper vision and to avoid accidents. Therefore, the council is liable to pay the public liability compensation. The council was ordered to compensate for the injuries suffered by the lady.
