Nurse wins £21,000 unfair dismissal compensation claim

A nurse who was wrongly sacked following allegations she 'mistreated' a patient, has won £20,000 public liability compensation from a Greater Manchester hospital.

A disciplinary hearing at Salford Royal Hospital found the claimant, aged 36, had ill-treated the disabled patient.

She was accused of slapping, throwing wipes that had been used for cleaning, making abusive gestures and forcefully ‘tapping’ the 53-year-old man, who was being treated in the hospital’s neuro high-dependency ward in September 2007.

The panel decided her conduct was "wholly unacceptable and unprofessional" and she was dismissed the following month.

But the nurse, from Eccles, who was acquitted of criminal charges over the incident, has always denied the allegations.

She took an unfair dismissal case to an employment tribunal and won but the hospital appealed the decision and it was overturned.

Now the Civil Appeal Court has ruled in the claimant’s favour, ordering the trust to pay her £21,266 in compensation claims and legal costs.
