Public liability compensation for Man Attacked With Stick

In a public liability claim, Blackburn magistrates have ordered a Clitheroe resident to pay £100 in a compensation claim to another man who he attacked with a stick.

The court heard that the defendant, 32, was waiting inside the Low Moor Club with the stick held above his head, after he was earlier attacked by a group of youths.

He swung the stick at the first person to enter, who was actually an innocent man.

He was convicted of the assault, and ordered to pay personal injury compensation to the man he hit who was returning to the club with his girlfriend.

At the sentencing hearing he was ordered to compensate the victim with £100 and was also given a 12-month community supervision order.

Mr Don Green, prosecuting, said the victim had gone outside with his girlfriend where there was a verbal altercation with three teenagers.

As they made their way back inside, he was confronted by the defendant, and he was struck in the face with a piece of wood before his assailant was restrained by other club members.

Miss Clare Knight, defending, claimed that during an earlier incident her client had come under attack by a gang of youths.

She said: “He describes being jumped on and kicked and when he was interviewed by the police showed them a black eye and two missing teeth.

“He believed the person he hit was one of those who had assaulted him.”
