Victim of head injury claims professional negligence compensation
A man who worked as a team leader for a large manufacturing firm was recently successful in his claim for professional negligence compensation following an incident in which he received a severe head injury from a large falling metal object.
During the course of ordinary work, the object fell, swiftly and suddenly, from above, where it had been carelessly placed in a manner that showed an insufficient care for the safety and wellbeing of workers. The object knocked the man immediately unconscious, needing to be rushed to hospital to be treated for his injury. It was, however, so severe an injury that it continued to cause additional medical problems beyond the wound itself; these included neck pains, headaches and chest pain. These were so severe as to cause him future difficulties in his employment, not to mention requiring that he be given constant care. The fact that his quality of life was strongly negatively impacted by his injury was taken into account in calculating the professional negligence compensation to which he was entitled.
His employer admitted professional negligence in failing to ensure that all workers were provided with a safe environment; the man was awarded an undisclosed sum in professional negligence compensation.
