£90,000 after 40ft fall

A scaffolder has been awarded £90,000 for personal injuries sustained in a 40 ft fall at work, resulting due to professional negligence of his employers, in July 2007.

The 43 year old man from Newcastle, worked as an advanced scaffolder and was off work for eight months with his personal injuries after the accident.

During the time of the accident, he was dismantling scaffolding for his employer, when he fell through what he assumed to be a metal grating platform, which turned out to be plastic demister packs.

He suffered from fractured ribs, suspected fractures to his spine, dislocation and nerve damage to his left shoulder.

As a result of his injuries, he is now unable to use his arm to work above shoulder height without pain and discomfort, and he has been unable to return to his trade as a scaffolder.

He has instead found less physically demanding work as a scaffolding inspector in Abu Dhabi.

His injury lawyers argued the platform was unstable and unable to hold the man's weight. They said his employers should have warned him about the dangers.

His employers disputed liability for professional negligence throughout but with the trial impending, they settled the compensation claim out of court.
