Company fined for fatal breaches
Hamilton Sheriff Court has imposed a £70,000 fine on the employer of a security guard who died after suffering from carbon monoxide poisoning.
The incident happened while he working on a construction site in Scotland, said his relatives who wish to pursue a compensation claim.
The man's employer admitted to breaches of the Health and Safety at Work Act.
The worker was overcome by fumes emanating from the site's petrol generator, which led to the security guard's death due to carbon monoxide poisoning.
Personal injury lawyers for the family said that the construction company may also face criminal proceedings in addition to the fine and a possible accident claim.
A crown office spokesperson commented, "As further criminal proceedings are under consideration, a decision regarding a Fatal Accident Inquiry will not be made for some time."
The victims lawyers said that the Health and Safety Executive's Prosecution Report concerned two organisations.
The carbon monoxide poisoning death occurred on February 6, 2008, said the lawyers.
