What Does A ‘No Win No Fee’ Solicitor Do?
Here at Accidents Direct, we only work with Solicitors that can offer you a ‘No Win No Fee' agreement. Your appointed Solicitor will not charge you any costs for making the injury claim and can ensure that you can keep 100% of your compensation, win or lose.
Firstly, the solicitor will send out a letter of claim to the defendant. This is to inform them of your intention to claim for compensation for the injury caused to you. You will then be asked to go for a medical assessment to see how badly your injury has affected you. Lastly, your appointed Solicitor will assess your loss of earnings and out of pocket expenses and try to recover these.
Will I have to go to Court?
In today's society, there are many ways to solve a legal problem and your claim does not always have to end up in court. The only time this would occur is if the defendant disputes your claim. If an agreement cannot be settled out of court, then your claim may involve court proceedings. The majority of cases will not come to this however.
What happens if the Solicitor wins my case?
As the Solicitor is working on a ‘no win, no fee' basis, he or she will only be paid if the claim is successful. He or she will also be entitled to an extra fee, known as a success fee. Both of these fees are usually paid in part or whole by the losing side.
There are also other incurred costs such as court fees or the fee for a medical report, which are known as disbursements. Again, the losing party should cover the cost of these and nothing is deducted from your compensation.
What happens if the Solicitor loses my case?
Accidents Direct has a very high success rate, however from time to time, some cases will be unsuccessful. If this happens, we will ensure that you have insurance to cover this risk. This is called ‘before the event' and ‘after the event'.
