Mobile Phone causes Broken Collar Bone
A man was hospitalised for eight weeks as a result of a third party driver texting on her mobile phone.
The 30 year old man was driving on a single carriageway when he approached a cross-road whereby he had right of way, as signaled by the green traffic light.
The third party driver emerged from a side road on the right hand side consequently running a red light.
The Police attended the scene of the accident and found the third party driver in a stationary position in the middle of the road.
The third party driver was found sitting in her vehicle in shock and still clutching onto her mobile phone. She was issued with six points on her drivers licence and a £200 fine.
The claimant sustained a broken collar bone, severe whiplash and minor head injuries. He was unable to work for four months and as a self employed plumber he was unable to earn an income which led to him being forced to re-mortgage his home.
The claimant researched bringing forth a ‘No win No fee’ claim as advised by a colleague.
He stated, “This accident has turned my life upside down…I in no way believe that six points and a fine is justice for what I have been through. If I had never brought forward a claim I would not have been able to support myself or my family.”
The man received £5,500 in compensation for suffering injury and to recover his loss of earnings.
