Mother Takes No win No fee Legal Action for Injured Daughter
The mother of a nine-year-old girl who suffered whiplash and burn injuries after being struck by a car, has commenced a civil no win no fee claim, after learning the driver will not face criminal charges.
The girl was among eight pupils who were taken to hospital following the incident, in which a 41-year-old woman motorist lost control of her vehicle and mounted the pavement.
The crash happened just outside All Saints’ Church, while a group of pupils were on a supervised walk. At the same time mourners were gathering for a funeral.
A man attending the funeral pulled the girl free, after she was pinned underneath the car when it mounted the pavement.
Suffolk police have announced that following consideration of her medical condition, the driver who caused the car accident will not face any criminal charges. However, her driving license has been revoked for six months, at which point a review will determine whether she is fit to get behind the wheel.
The girl’s mother said: “My daughter is one of the luckier ones, but this has affected her.
“She is up every night crying, thinking she is being run over. My daughter has got scars on her arms and she has been diagnosed as having post traumatic shock disorder.”
It is anticipated that the accident claim will attempt to secure compensation for whiplash, burn injuries, posttraumatic stress disorder and other losses.
