Have you sustained a trip or a fall? Here at Accidents Direct, we are experts in handling such claim. What we can do is to help you claim compensation for the injuries you have sustained as a result of your fall.
- Witness. S.58 of the Act provides a defence for the council or local authority to prove, that such care, as was reasonably required, had been undertaken to ensure that the part of the road/pavement was not dangerous. Your witness is there to disprove this fact, whereby he must confirm that the defect had been present for at least 6 months (in circumstances where the accident happened on a road, the defect have to be present for 12 months), thereby implying that inspections and repairs had not been carried out for that amount of time, thus proving that the council or local authority had been negligent in carrying out their duties.
- Report. It is recommended that you report the accident to the council or local authority so that they are aware of the matter, and include time and date. When reporting, it is recommended to do it in such a way that there is a record of the report. For example, writing a letter or sending an email. MAKE A COPY OF THIS REPORT and keep it. These things can “magically disappear” once it have reached the hands of the liable party, so a copy proves that you have gone to great lengths to inform the relevant authority.
- Medical records. The compensation you will receive is based on your medical records so it is important to go to the hospital, walk in centre, or doctor’s surgery to have your injuries treated. As we are not medical experts, sometimes your symptoms can be worse than what you believe, therefore it is a good idea to have yourself checked out.
- Etc. Further evidence such as poor lighting in the area, contact details of any passerby who came to your aid, any time off work taken, whether the accident was reported to your place of work, etc. can be useful.
In any event, it is encouraged to ACT FAST. The longer you leave it, the harder it may be to help you and the more evidence you will lose. If you follow the above criterion, this will ensure you have strong grounds to Make A Claim. Once you have the above at hand, give Accidents Direct a call. It will take less than 10 minutes and we will be able to get you in touch with one of our No Win No Fee* solicitors.
