Injury lawyers to be put on trial
Personal injury lawyers are set to be put on trial themselves by customers who feel they have not provided proper and appropriate representation according to latest news released this week.
The pressure will be applied by the new online company, knwon as www.claimsagainstsolicitors.com, which belives that they must be a voice for claimer's everywhere.
If a client feels that their claim has been handled inadequately and the maximum gain has not been achieved, Moore Blatch Resolve is the place to go.
The company are under the impression that a large number of claims are taken over by overworked or non specialist lawyers who fail to maximise the possible lump sum amount awarded to client.
"There are quite a few firms out there who really don't have the proper skills to be dealing with these cases," says partner Damian Horan. "They dabble and don't know when they are in above their neck."
Viable case studies have been put forward, which highlight the potential for growth within the market. Only recently the company won £500,000 for a motorbike rider, helping him to sue the law firm which was in charge of his claim.
Claim
The rider had suffered a head injury that was the fault of someone else, but under the direction of his solicitors his case was mistakenly taken to an expert within the medical field for a second opinion.
At the time the man won £50,000 pounds, on the basis that he suffered an injury, which was not particular severe, especially since the man returned to work six months later. This decision was proved to be unfounded soon after as the man suffered mood swings, flashes of anger which indirectly led to his girlfriend leaving him and the continued inability to find any future employment.
Despite four years elapsing the man went to Moore Blatch Resolve, who managed to claim an amount which dwarfed the initial payout.
The case does indeed show the potential available for those who feel that they haven't achieved their maximum rewarded for their injures.
Detail
The new company will concentrate on personal injury and medical negligence claims which have been in some way mishandled, a service which is set to attract a lot of visitors considering there are around 250,000 people injured in road accidents alone every year.
Many experts agree that there is scope in this market, which does put pressure on those within the personal injury industry.
Steve Manton, chief executive of M Consulting said: "One of our insurance clients withdrew from this market completely on the grounds that claims are going to escalate very rapidly."
"The recession will turn up lots of instances of mistakes made on valuations, poor advice on tax and other solicitor errors on which their clients could base negligence claims, says Manton. Most solicitors are honest but there is a fair amount of fraud being uncovered."
