Worker compensated for shoulder injury

Injury lawyers for a mechanical fitter who sustained personal injury in a work accident, have won him more than £5,000 in a compensation claim.

The 59 year old man, from Whitehaven, needed surgery on his shoulder following the incident, that took place in August 2008. He also had to take six months off work following the accident.

His lawyers said that he suffered traumatic tendonitis while using a tool that was clearly unsuitable for the job. The condition left his shoulder in extreme pain which could be rectified only with the help of surgery.

The employee said: “I tried to struggle on with my personal injuries at first but my shoulder only got worse and I had to stop working."

His lawyers argued that his employers should have provided a more modern electric tool to handle extentive pressure to the shoulders. The man's employers admitted liability and settled the claim out of court.

He is now been able to return to work and is fully fit. "This compensation will help me to pay for the cost of the private consultations I had,” he stated.

“Businesses are expected to keep themselves up to date on ways that manual handling roles can be made as safe as possible," added his lawyers.
