Mobile phone crash

It has been revealed that a couple have filed a compensation claim suing the estate of a van driver, after they suffered a car accident which left their son confined to a wheelchair.

They allege that the man, who died when he collided into their car, was talking on a mobile phone. They state that the van was also overloaded while travelling on the M8.

The mother was driving along the opposite carriageway with her two children when the van lost control and crashed towards her on its side.

The accident, near Shotts on 29 December, 2007, concluded that the male motorist, a Chinese supermarket worker formerly of Falconer Rise in Livingston, was solely to blame for the crash.

The couple have already settled a claim for their 15-year-old son who was left paralysed due to the crash, but they are still seeking damages for injuries sustained to the mother.

She stated: “This isn't a lottery win. We've been left with a lot of bills for things like adapted cars and other medical costs.

“I have no feelings towards the driver whatsoever. The man left behind a family and we are sympathetic to that. I feel for their loss.

“However, people need to be made aware of the consequences of their actions if they break the laws that have been put in place to save lives.”

The family’s injury lawyer confirmed that they are seeking compensation against the estate.Updated on 02/02/2010
