Injury Lawyers have helped a construction worker gain compensation after he was injured whilst working on a pier. The lawyers may be able to recover damages in addition to those provided under Worker’s Compensation coverage.
The work accident occurred when the labourer was not given the correct equipment to lower himself approximately 15 feet to the base of the exhaust well to do welding work. Therefore, due to health and safety violations the worker suffered personal injuries.
Due to the nature of the accident the plaintiff was awarded benefits under the LHWCA because he was injured on ‘navigable’ waters. These benefits were established as a long term compensation scheme to help longshoremen and harbour workers with medical bills, survivor benefits and work injuries.
The worker was able to claim under New York Labour Law 240 (1) which states that property owners have a duty to provide a safe working environment against falling from a height.Updated on 11/11/2008
