A boy, who was injured when he fell down a changing table in a nursery as a baby, is suing the nursery for over £5 million in compensation.
The injury left James Pitcher, of Woodmere Gardens, brain damaged.
He was just nine months at the time of the accident in August 2004 and now takes his compensation case to London’s High Court.
Joined in the suit are owners of the nursery, Headstart Nursery Ltd and Caroline Gooding, under whose care he was at the time of the injury, as well as the Mayday Hospital NHS Trust.
The four-year-old boy’s lawyers are suing the NHS Trust for a delay in diagnosing his condition at Mayday Hospital, Croydon.
The defendants had in May this year admitted liability and the court last week awarded the boy through his father, an interim payment of £320,000 following argument by his lawyer that without the money the family would find themselves in a difficult financial situation.
