Maintenance of public highways such as roads and pavements is governed by the Highways Act 1980.

The criteria for making such claims are relatively simple.

  1. Pictures. The provision of the Highways Act require councils and local authorities to carry out inspections on roads and pavements regularly, i.e. every 6 months, where it is deem dangerous for motorists and pedestrians. This mean that the defect must meet the criteria in that it is dipped/raised to ONE INCH on pavements and TWO INCHES on roads. Go back to the area where you fell and take a picture of the defect using something such as a ruler to give an idea of scale, and measure the width and depth of a pothole. Or get someone to do that for you.
