Lorry crash victim loses compensation battle

A paperboy who was hit by a lorry five years ago has lost his compensation claims battle.

The victim was aged just 13 when the accident occurred but the Appeal Court has denied any personal injury payout settlement.

The teen, suffered an open head wound, ruptured kidney, fractured pelvis, broken teeth, bruised lungs and a brain injury, after he was hit by a lorry back in September 2005.

Despite the massive amount of injuries inflicted, top judges ruled that the motorist could no way be blamed for the collision.

The judge instead decided that the victim had, without looking, ridden his bicycle out of a driveway and straight into the lorry, whilst on a paper route.

The defendant was only going 30mph and was labelled an “impressive witness” and his standard of driving amounted to a “counsel of perfection.”

In a twist to the case, the judges therefore ruled that the driver should receive compensation from the boy’s employers for post-traumatic stress disorder. The total will be decided at a separate hearing.
