Drivers
Have you been involved in an accident where it was not your fault ? Has your insurance denied liability on your behalf ? Where the liability is on the part of the third party for failing to drive with due care and attention, and you have been injured, we would like to help you make a Personal Injury Claim.
In situations like these, you want to obtain details of the third party that was involved so that they can be held responsible for the damage to your car, and to yourself.
This is what you can do to make your claim for compensation stronger:
- 1 - Obtain the vehicle registration number of the other person’s car and the car model. Taking down the car’s VRN is as very important step because, say for example the person has given you a false name and telephone number, by obtaining the car’s VRN allows you or your solicitor to trace its rightful owner(s)
- 2 - You can then liaise with the other person to obtain his other details such as name, address, telephone number and insurance details
- 3 - Call the police if necessary
- 4 - Seek medical attention immediately so that your injuries are recorded. Remember also that the compensation you will receive is based on your medical records
In the case where your insurance has admitted part liability (50/50), you are still entitled to make a personal injury claim if you can prove that you are in pain for 8 weeks or more. Similarly, if it was a head on collision.
We can only help you if your insurance company has disputed full or part liability. Therefore if your insurance has admitted liability, the accident is then deemed to be your fault and as such, we are unable to help
Passengers
Passengers can always make a claim for personal injury. Fact
The claim will either be brought against the third party, or your driver friend/relative. This is all dependant on whose fault the accident was deemed. Of course you will need to follow the guidelines above such as obtaining the VRN of the liable party. If in doubt as to whose fault the accident is, obtain both VRNs, i.e. the third party’s as well as the car that you were a passenger in
