Driver claims after mobile crash
A young motorist has been awarded with tens of thousands of pounds after being involved in a road accident.
The car accident took place in April 2006, where the 19 year old had been driving home from a friend's house when she was involved in a four-car pile-up. Her Renault Megane was hit from behind by a Ford Focus, which sent her smashing into two other cars.
The girl made an accident claim for both physical and psychological personal injuries.
It was later found that the driver responsible for the accident had been chatting on her mobile phone when she took her eyes off the road, lost control of her vehicle and subsequently caused a serious road accident.
Awoke in hospital
The injured driver remembered little after the car accident occurred and woke up in hospital because a witness called for an ambulance. Doctors told her that she had sustained a neck injury which they suspected was a serious case of whiplash and a fracture to her knee which would have to be cast.
The young driver stated that she felt, "very confused and upset after she started to remember what happened". The driver also said that she woke up sweating and screaming during the first night she spent in hospital after the car crash.
She continued to have nightmares, became very distressed when anyone talked about driving and also refused to even think about setting foot in a car for a long time. Doctors diagnosed her with Post-Traumatic Stress Disorder and advised that she visit a counsellor and prescribed her a course of anti-depressants.
After returning home from hospital, the young woman continued to see a therapist to help come to terms with her ordeal and had to take four months off from work as a sales consultant, while her knee and whiplash injuries healed.
Making the claim
A work colleague, who visited her at home, advised that she should look into making a claim for the car accident, against the driver that caused the crash.
The friend gave her a contact number of an injury lawyer's firm and told her that she should make a claim with them, because her brother had made a successful compensation claim for a work accident a few months earlier and had just received an out-of-court settlement without any hassle or having to pay out a penny in costs or fees.
This appealed to the Hampshire teen who then contacted the firm to find out about making the claim. She was assured her that they would work under a no win no fee basis and that making a claim wouldn't cost a penny. She said that she would like to go ahead and make a claim against the motorist using the mobile phone.
The injured driver was assigned with a personal injury lawyer that specialised in car accident claims and whiplash injury claims. Her lawsuit was a success.
The personal injury lawyers fighting her case enabled the young driver to be awarded with just under £38,000. This helped to cover the pain and mental anguish from the car accident and her subsequent injuries, as well as recompensating the earnings that she had lost and the cost of prescriptions and therapy she had to take out.
