Motorcyclist’s claim denied
It has been revealed that a motorcyclists accident claim has been denied by a High Court judge.
The man suffered leg personal injury in the crash, after his bike hit a tractor in June 2006.
The accident left him with continuous pain and the threat of osteomyelitis (an infection of the bone) occurring.
His injury lawyers alleged that the driver of the tractor turned right into a field at a time when it was unsafe to do so and crossed into the claimants path. The tractor driver claimed that the bike was not in sight when he began to turn, whilst travelling at considerable speed.
Judge Richard Seymour QC ruled that the accident was primarily caused by the excess speed of the biker and decided that he was travelling well above the speed limit.
Therefore, the claimant's case was dismissed and he will not receive the six figure payout sum he was hoping for.Updated on 24/05/2010
