Counter accident compensation claims for road negligence
A widow and a skateboarder are both trying to claim compensation from each other in an almighty legal battle over an accident claim which goes back to a crash, which happened in April 2007.
The incident in question involves a man who was travelling on his motorcycle and a young teenager who was on his skateboard.
The motorcyclist swerved to avoid the teen, but his swerve took him into the path of an oncoming car and they crashed.
Unfortunately the biker died from his injuries in the accident which included a fractured skull and chest trauma.
The skateboarder was travelling on his board to school on the roadway with his friend whose skateboard went into the road.
He then went to retrieve it but was hit by the motorbike as it swerved. The teen suffered a broken collar bone in the incident.
Now the widow of the biker has launched a compensation claim against the teen for £300,000 in reparations.
She declared that the skater is to be held responsible for running into the road without seeing the motorbike approaching.
The teen however has launched a counter claim against her for £25,000 in personal injury funds. He alleges that the motorcyclist was speeding – 60 mph in a 40 mph zone – and failed to pay full attention to the road.
He also alleges that the man's visor let in only 22% light transmission, which if true, makes his helmet illegal on UK roads
