Brain injury victim loses compensation battle

A man left brain damaged after being involved in a car accident when he was 12 has been refused his accident claim by a high court judge.

The man, now 23, was hit by a Renault Megane hire car on New Year's Eve 1998 in Holloway, London.

He suffered a fractured skull and severe brain personal injury in the collision, which has left him requiring full time residential care. He is unable to work or look after himself.

The judge noted in the hearing that there was a lack of police evidence surrounding the accident and that the only witness to the incident had emigrated and did not wish to give evidence.

The victim, who brought the compensation claim against the driver of the car through his mother, was hoping to receive damages to fund his lifelong care, but the judge ruled that the driver, who denied liability, was blameless and that his driving could not be criticised.
