Pensioner wins £4k compensation after mattress falls on his car on motorway
A Scottish pensioner has succeeded in receiving compensation after making an accident claim for an unusual road accident, in which his vehicle was hit by a falling mattress.
The 71-year-old, was driving along the M8 near Glasgow, when his car struck part of a bed which had come loose and fallen from the back of another vehicle.
A Glasgow sheriff ordered that the car crash claim be settled for £3,770 injury compensation after the defendant admitted liability for the incident, confirming that the mattress fell from the back of his vehicle.
The sheriff commented, "The pursuer's accident was caused by the negligence of the defender.
"The pursuer, having suffered loss, injury and damage due to the defender's negligence, is entitled to reparation.
"Very little of the evidence was in dispute. The pursuer gave evidence in a straightforward way.
“I found him to be credible and reliable. The symptoms spoken of by him were entirely consistent with the views expressed in the agreed medical reports.
"There is no question, in my view, of the pursuer exaggerating his symptoms."
In summing up the car crash claim, the sheriff said that the accident had exacerbated an injury sustained by the 71-year-old claimant in a previous road traffic accident.
