Jurors decide no medical negligence

A Rutherford County jury has decided after a 24 day trial and hearing 37 witnesses testify that a doctor and two nearby surgeries are not guilty of
medical negligence
.
The accusation was made by Leigh Ann and Alan Taylor, who filed a $40 million lawsuit against Middle Tennessee Medical Center, Murfreesboro Medical Clinic and Dr. Lynn Ellington in December 2002.
They felt that during their daughters delivery, the two establishments and Dr Ellington had failed to give full support, resulting in sever medical conditions in the newborn.
"We are gratified of the jury's decision," said C.J. Gideon, who represented Ellington and Murfreesboro Medical Clinic. "It was clearly the right decision. The proof was overwhelming that Dr. Ellington did precisely what she was supposed to do and that she did not injure this child."
The Taylors’ on the other hand, do not feel the same, left to cope with a daughter with severe brain damage, cerebral palsy, developmental delay and seizures.
"We are extremely disappointed in this seemingly rushed verdict in a trial that lasted almost seven weeks and jury deliberation that only lasted five hours," Taylor said. "We feel like our daughter did not receive justice. This lawsuit was for her, and we would not have received a dime."
